Release Reporting Regulation

The Environmental Protection and Enhancement Act (EPEA) deals
with the release of substances into the environment, and sets out
requirements for the reporting of such releases to Alberta Environment.
Background
Under previous legislation, release reporting requirements were not
consistent. For example, reporting releases of water contaminants was
dealt with in the Clean Water (General) Regulations, the Clean Air
(General) Regulations for release of air contaminants, and in the
Hazardous Waste Regulation for releases of hazardous waste.
Overview
Alberta's environmental laws have been consolidated and updated by EPEA.
Part 4, Division 1 of the Act deals with the release of substances into
the environment, and sets our reporting and remedial requirements with
respect to substance releases.
The Release Reporting Regulation consolidates reporting provisions
found in previous environmental legislation to provide consistent
requirements for all types of releases, and provides greater detail with
respect to reporting and requirements in the Act. This regulation
replaces the following legislation:
- Clean Air (General) Regulations;
- Clean Water (General) Regulations; and
- Hazardous Waste Regulation.
Regulatory Details
The Release Reporting Regulation sets out clearly the minimum reportable
quantities of substances as referenced in the Transportation of
Dangerous Goods Act (Canada) and in the lists of toxic substances,
prohibited substances and restricted substances under the Canadian
Environmental Protection Act.
Requirements for written release reports have been modified in this
regulation to ensure consistency in all situations where such reports
are provided. This regulation also extends the submission deadline for
written reports from 48 hours to 7 days.
Exemptions from reporting have been clearly provided in this
regulation.
